1. Introduction

These Terms of Carriage (“Terms”) govern the transportation, handling, storage, and delivery of goods (“Shipments”) by EuraWays Logistics Limited (“we”, “our”, “the Company”) and its partners, subcontractors, and carriers.

By booking a shipment or using our logistics services, the Client (“you”, “your”, “the Shipper”) agrees to these Terms.

These Terms apply to:

  • Air freight

  • Sea freight

  • Rail freight

  • Road transport

  • Warehousing and consolidation

  • Multimodal transportation

  • Customs processing & related logistics services


2. Nature of the Company

EuraWays Logistics Limited operates primarily as a freight forwarder and logistics coordinator, not as a direct carrier unless explicitly stated.
We organize transport using third-party carriers, trucking companies, airlines, shipping lines, and handling agents.

All carriage is subject to:

  • International transport conventions

  • Carrier conditions

  • Local regulations of origin, transit, and destination countries


3. Client Obligations

The Shipper must:

a. Provide accurate information

Including:

  • Commodity description

  • Weight, dimensions, and packaging details

  • Dangerous goods classification (if applicable)

  • Customs documentation

  • Regulatory certificates

  • Commercial invoice & packing list

Incorrect or missing information may result in delays, fines, or refusals.

b. Ensure proper packaging

The Shipper is fully responsible for:

  • Secure and compliant packaging

  • Proper labeling

  • Palletization, protective materials, weight stability

Improper packaging voids liability.

c. Comply with applicable laws

The Shipper must ensure that all goods comply with:

  • Export and import regulations

  • Sanctions and trade restrictions

  • Customs declarations

  • Safety rules (e.g., IATA, IMDG, ADR)


4. Right of Inspection

The Company, carriers, customs authorities, or security agencies may:

  • Inspect any shipment

  • Open packages

  • Request additional documentation

  • Hold or detain goods if suspicious or non-compliant

Such actions do not constitute a breach of contract.


5. Refusal of Carriage

We may refuse transportation if:

  • Goods are prohibited, restricted, or hazardous

  • Required documents are missing

  • Packaging is inadequate

  • Shipment poses safety or compliance risks

  • Instructions are unclear or contradictory

  • Fees or outstanding balances remain unpaid


6. Prohibited & Restricted Goods

Unless expressly agreed in writing, we do not transport:

  • Weapons, ammunition, explosives

  • Controlled chemicals or hazardous goods

  • Illegal goods or counterfeit items

  • High-value personal items (jewelry, cash, art)

  • Perishables or temperature-sensitive items

  • Live animals

  • Items prohibited by carriers or customs

Transporting such items without disclosure results in immediate termination of service with no liability.


7. Transit Times

All transit times provided by EuraWays Logistics are estimates only.
We are not liable for delays caused by:

  • Customs inspections

  • Weather

  • Port/airport congestion

  • Security checks

  • Strikes or operational disruptions

  • Carrier schedule changes

  • Force majeure

No refunds or penalties apply unless expressly agreed in a contract.


8. Liability and Limits of Compensation

a. General Liability

If no cargo insurance is purchased, liability is limited to international conventions:

  • Air cargo → Montreal Convention

  • Sea freight → Hague-Visby Rules

  • Road transport → CMR Convention

  • Rail → Applicable regulations

These limits are significantly lower than the commercial value of goods.

b. Multimodal Liability

For combined transport, liability is governed by the convention applicable to the stage where damage occurred.

c. Exclusions

We are not liable for:

  • Poor packaging

  • Misdeclared cargo

  • Prohibited goods

  • Delays not caused by our direct fault

  • Indirect losses (lost profits, penalties, business interruption)

  • Acts of nature, war, political unrest, cyberattacks

  • Actions by customs or regulatory bodies


9. Cargo Insurance

Full cargo insurance is optional and must be requested before pickup.
If no insurance is purchased:

  • Compensation is limited

  • The Shipper bears the financial risk for loss or damage exceeding liability limits

Insurance requires:

  • Complete shipment declaration

  • Accurate cargo values

  • Compliance with documentation requirements


10. Delivery & Receipt of Goods

Upon delivery:

  • The receiver must inspect goods immediately

  • Any visible damage must be reported in writing on the delivery receipt

  • Concealed damage must be reported within the allowed timeframe (see Claims Policy)

Failure to report issues promptly may void the right to compensation.


11. Charges, Fees & Payment

The Shipper agrees to pay:

  • Freight charges

  • Fuel and carrier surcharges

  • Customs duties and taxes

  • Warehousing or demurrage fees

  • Any charges resulting from incorrect information

  • Fines imposed by customs due to misdeclaration

The Company reserves the right to withhold cargo in case of unpaid balances.


12. Claims Process

Claims for loss, damage, or delay must follow deadlines:

  • Visible damage: 48 hours

  • Hidden damage: 7 days

  • Delay: 14 days

  • Loss: 30 days after ETA

Claims must be submitted according to our Refund & Claims Policy.


13. Lien Rights

The Company holds a general lien over goods for:

  • Unpaid freight

  • Storage fees

  • Duties, taxes, and penalties

  • Operational charges

If not settled, goods may be sold to recover losses.


14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Hong Kong Special Administrative Region (HKSAR).
All disputes shall be resolved exclusively in the courts of Hong Kong unless otherwise agreed in writing.
